Trademarks confer a subjective exclusive right on their owner. However, the scope of this trademark right is highly controversial, which in practice has already led to numerous preliminary ruling proceedings before the ECJ. In particular, the interpretation of the term "use" of a trademark plays a central role. The revisions of the elements of infringement and of the limitation provisions in the course of the 2015 trademark law reform as well as the case law of the ECJ in the "Mitsubishi" case provide grounds for further investigations in this context. The aim of this thesis is to find a concept of the term "use" that is consistent from a systematic point of view, that is uniformly applicable to all elements of infringement and that leaves a distinct scope of application for all provisions on limitations.
