German description: Die zunehmende wirtschaftliche Bedeutung verschiedener Abtretungsgeschafte bei gleichzeitig fortschreitender Globalisierung erfordert eine einfach zu handhabende Kollisionsregel fur internationale Sachverhalte. Art. 14 Rom-I-Verordnung bietet ein Grundgerust, lost aber insbesondere die wichtigste Frage bezuglich der Drittwirkung der Abtretung nicht. Die europaische Kommission ist seit 2010 im Verzug, diesen Missstand zu beheben. Hendric Labonte untersucht auf Grundlage des materiellen Abtretungsrechts Deutschlands, Frankreichs und Englands sowie verschiedener bereits kodifizierter kollisionsrechtlicher Losungsansatze, welchen Regelungsgehalt Art. 14 Rom-I-Verordnung de lege lata hat. Davon ausgehend schlagt er unter Berucksichtigung der unterschiedlichen beruhrten Interessenlagen fur die Drittwirkung die Massgeblichkeit des Forderungsstatuts vor. Die Arbeit mundet in einen entsprechenden Regelungsvorschlag de lege ferenda .
